LEGAL INFORMATION
General terms and conditions
Valid from 23 October 2026.
1. Introductory provisions and operator
In accordance with Section 1751(1) of Act No. 89/2012 Coll., the Civil Code (the “Civil Code”), these general terms and conditions (the “Terms”) govern the mutual rights and obligations of the operator and the customer in providing and using the MůjStavebník service (the “Service”).
The Service is operated by Michal Barvíř, IČO 10869409, registered office at T. G. Masaryka 956, 517 21 Týniště nad Orlicí, Czech Republic, a natural person doing business under the Trade Licensing Act, entered in the Trade Register (Trade Licensing Office Kostelec nad Orlicí) (the “Operator”). Place of business: T. G. Masaryka 956, 517 21 Týniště nad Orlicí. E-mail: barvirmichal@seznam.cz, phone: +420 736 439 177, customer support: info@mujstavebnik.cz.
2. Who the Service is for
The Service is intended exclusively for entrepreneurs and legal entities for their business activities (the “Customer”). When registering, the Customer provides its company identification number and confirms that it enters into the contract as part of its business. The consumer protection provisions of the Civil Code therefore do not apply to the contract; in particular, there is no right to withdraw from a distance contract (Section 1829 of the Civil Code). The Service cannot be ordered as a consumer; the Customer is responsible for the truth of its declaration.
3. Conclusion of the contract
The contract for the provision of the Service (the “Contract”) is concluded electronically by registering on mujstavebnik.cz, accepting these Terms and verifying the e-mail address. The Contract is concluded when the account is made available to the Customer. The Contract is concluded in Czech; it consists of these Terms, the price list valid on the order date and the data entered at registration. The current version of the Terms is always available on this page; the Operator will send earlier versions on request. The Customer bears the costs of means of distance communication (internet, telephone).
At registration the customer fills in a form with company details and a login e-mail; before submitting, they can check and correct all details, and after submitting they can correct them in the account settings. By submitting, the customer confirms that they have read and agree to these terms. The operator archives the concluded contract electronically (record of registration, consent and the version of the terms valid on the day of conclusion) and makes it available to the customer on request; it is not made available to third parties. A demo or trial access agreed with the operator can also be set up without registering on the website – the contract is then concluded when the account is made available.
4. Service and licence
The Service is software for managing construction projects provided over the internet (SaaS) in a web browser and in mobile apps for iOS and Android. The scope of features is described on the Features page. For the term of the Contract, the Operator grants the Customer and its users a non-exclusive, non-transferable and territorially unlimited right to use the Service within the chosen plan. The Operator continuously develops the Service and may change features provided this does not substantially impair what the Customer uses.
The mobile apps are free to download and provide access to an existing account. Subscriptions are arranged and paid exclusively on the website; nothing is bought or paid for in the mobile apps.
Intellectual property. The software, design, texts, the designer item catalogue, document templates and other parts of the service are protected by copyright and belong to the operator or its licensors; the customer acquires no rights other than the right to use the service under these terms. The customer may not copy, modify, reverse engineer (beyond what the law expressly permits), resell or make the service available to third parties other than its own users. Content that the customer enters into the service (data, photos, logos, documents) remains the customer's; the customer grants the operator a licence to it only to the extent necessary to provide the service (storage, display, calculations, export).
Artificial intelligence features. Some features (e.g. the interior design assistant or connecting the customer's own assistant via the MCP interface) use artificial intelligence models. Their outputs (layout suggestions, texts, estimates) are indicative, may contain inaccuracies and the customer verifies them before use. The design assistant passes to the model provider only the text of the request and technical design data (dimensions, fittings), not personal data of employees or customers. If the customer connects its own assistant via MCP, the data it allows access to are processed by the provider the customer has chosen, and the customer is responsible for that transfer.
5. Registration and user accounts
When registering, the Customer provides true and complete company details and keeps them up to date. The Customer is responsible for the accounts of its employees and collaborators, their permissions and the confidentiality of login credentials. The Customer must notify the Operator without undue delay of any suspected misuse of an account.
6. Trial period
The provider may, but need not, offer a trial period; its current availability is stated on the website. Where offered, the service is free for the first 30 days after the account is made available, with no obligation to enter payment details. After the trial period the service is not charged automatically: if the customer does not order a plan, write access is restricted and the data remains stored for at least 30 days so it can be exported or the subscription continued. The same rules apply to a demo or trial access arranged with the provider.
7. Price, invoicing and payments
The price follows the price list valid on the order date according to the selected plan. The Operator is not a VAT payer; the prices in the price list are final.
The Service is invoiced in advance for the chosen period (month or year). The invoice is delivered electronically and is due within the period stated in it, usually 14 days. Payment can be made by bank transfer (including QR payment) and, where the Operator offers it, by card through a payment gateway. Payment is made when credited to the Operator’s account. Fees paid are non-refundable unless Article 15 provides otherwise.
If payment is late, the Operator sends a reminder; if the Customer does not pay within 7 days of it being sent, the Operator may restrict access to read-only mode until payment; the obligation to pay remains. The Operator is entitled to late-payment interest under Government Regulation No. 351/2013 Coll. The Operator announces price changes at least 30 days in advance; the new price applies from the next billing period, and a Customer who does not agree may terminate the Contract.
8. Customer’s rights and obligations
The Customer uses the Service in accordance with the law and these Terms. It must not misuse it, in particular compromise its security, circumvent permissions, attempt to access other customers’ data, load it with automated requests outside the published API or upload unlawful content or malicious code. The Customer is responsible for the content it uploads (projects, documents, photos, personal data of employees and customers).
9. Availability, maintenance and support
The Operator strives for the highest possible availability of the Service but does not guarantee uninterrupted or error-free operation. It may restrict or interrupt the Service for the necessary time due to maintenance, updates, security or an outage on the side of third parties; planned maintenance is preferably carried out outside working hours. Support is provided by e-mail and chat in Czech on working days, usually within one working day.
10. Service defects and complaints
The Customer reports a defect of the Service (an error or unavailability) without undue delay by e-mail or in the support chat, describing how it manifests. The Operator remedies the defect within a reasonable time and informs the Customer. Remedying the defect is the Customer’s primary remedy; the Customer may claim a price reduction or terminate the Contract only if the Operator fails to remedy a material defect even within an additional reasonable period of at least 30 days. Claims for defective performance and damages become time-barred after one year (Section 630 of the Civil Code).
11. Customer data, backups, export and switching to another provider
Data entered by the Customer belong to the Customer. The Operator processes them only to provide the Service, does not pass them to third parties for marketing and backs them up daily. Backups serve to restore the Service as a whole; the Customer is responsible for regularly exporting data it considers important. The Customer can export the data at any time in a structured, commonly used and machine-readable format (e.g. CSV, JSON, PDF and ISDOC). The Operator may use anonymised aggregated usage data, from which neither the Customer nor any person can be identified, to improve the Service.
In accordance with Regulation (EU) 2023/2854 (the Data Act), the Customer has the right to switch to another provider or to its own infrastructure: it may terminate the Contract with a notice period of no more than two months, followed by a 30-day transition period during which the Operator cooperates and enables the export of all exportable data, after which the data remain available for download for at least another 30 days. The Operator charges nothing for switching or data export. After these periods the Operator deletes the Customer’s data; they are erased from backups as the backups are regularly overwritten.
12. Processing of personal data on behalf of the Customer (data processing agreement)
For personal data that the Customer enters into the Service (in particular employee data, attendance including location when clocking in and out, customer data and photos), the Customer is the controller and the Operator is the processor under Article 28 of Regulation (EU) 2016/679 (GDPR). This article constitutes the data processing agreement:
- Subject matter, purpose and duration: processing takes place only to provide the Service for the term of the Contract and the periods under Article 11.
- Categories of data and data subjects: identification and contact data, work and attendance data, location at the moment of an attendance entry, photos and data in documents; the Customer’s employees and collaborators, its customers and suppliers.
- Instructions: the Operator processes data only on the Customer’s documented instructions, which consist of these Terms and the Service settings, and informs the Customer if, in its opinion, an instruction infringes the law.
- Confidentiality and security: persons with access to the data are bound by confidentiality; the Operator has adopted technical and organisational measures under Article 32 GDPR (encrypted traffic, separated data for each company, two-factor authentication for administrators, audit trail, daily backups).
- Sub-processors: the Customer gives general authorisation for the use of server infrastructure and e-mail delivery providers bound by the same obligations; the Operator informs the Customer of any intended change in advance and the Customer may object to it.
- Assistance: the Operator helps the Customer handle data subject requests and fulfil its obligations under Articles 32 to 36 GDPR and notifies it of a personal data breach without undue delay after becoming aware of it; assistance beyond the functions of the Service may be charged according to the work actually performed.
- Termination and audits: after the Contract ends, the Operator returns the data by way of export and deletes them under Article 11, and provides the Customer with the information needed to demonstrate compliance with these obligations. The Customer may carry out an audit at most once a year, at its own cost, with at least 30 days’ notice and without disrupting the operation of the Service or the protection of other customers’ data.
Processing of personal data for which the Operator is the controller is described on the Privacy policy page.
13. Illegal content and point of contact
The single point of contact for public authorities, the European Commission and users under Regulation (EU) 2022/2065 (the Digital Services Act) is barvirmichal@seznam.cz; communication is possible in Czech, Slovak and English. The Operator does not review customers’ content in advance. Content that the notifier considers illegal can be reported to the same address – with a description, location, justification and the notifier’s contact details. The Operator assesses the notice without undue delay, disables access to illegal content, informs the notifier and the customer concerned of its decision and gives reasons. Decisions can be contested at the same address.
14. Liability
The service is a tool for record-keeping and calculations; the customer is responsible for the accuracy of input data and for decisions made on their basis (e.g. wages, taxes, prices, reports). The operator is not liable for damage caused by an outage of the customer's internet connection, interference by third parties beyond its control or force majeure. The operator is liable only for actual damage; it is not liable for lost profit, loss of data or indirect and consequential damage. The operator's total liability for damage is limited to the price paid by the customer for the last 3 months before the damage occurred. These limitations do not apply to damage caused intentionally or by gross negligence, nor to harm to natural human rights (Section 2898 of the Czech Civil Code). The customer shall compensate the operator for damage and third-party claims arising from content it entered into the service or from a breach of these terms. Calculations of quantities, materials, wages and prices as well as outputs of artificial intelligence features are aids; the customer checks them before use (e.g. in a quotation, invoice or material order).
15. Term and termination of the Contract
The Contract is concluded for an indefinite period. The Customer may terminate it at any time without giving reasons and without penalty by e-mail or a message in the support chat; the Service then continues until the end of the paid period, and the periods under Article 11 apply to switching to another provider. The Operator may terminate the Contract with one month’s notice. In the event of a serious breach of the Terms (in particular an attack on the security of the Service, misuse of the Service or a payment more than 14 days overdue after a reminder), the Operator may withdraw from the Contract with immediate effect. If the Customer terminates the Contract, fees paid are not refunded; if the Operator terminates it without the Customer having breached its obligations, it refunds the proportionate part of the price paid for the period after termination.
16. Changes to the Terms
The Operator may change these Terms to a reasonable extent (Section 1752 of the Civil Code), in particular due to changes in legislation, development of the Service or security. The Operator notifies the Customer of a change by e-mail or in the app at least 30 days before it takes effect. If the Customer does not agree, it may terminate the Contract without penalty before the change takes effect; otherwise the change is deemed accepted.
17. Notices and communication
Communication takes place electronically – by e-mail to the addresses stated in the Customer’s account and to the Operator’s address, or by a message in the app. A message is deemed delivered on the day it is sent unless proven otherwise.
18. Governing law, disputes and final provisions
The contract and the relationships arising from it are governed by the laws of the Czech Republic, in particular the Czech Civil Code. Disputes shall preferably be settled amicably; otherwise the court with local jurisdiction is the court of the operator's registered office. The parties exclude the application of Sections 1799 and 1800 of the Czech Civil Code on adhesion contracts, and the customer assumes the risk of a change in circumstances (Section 1765(2) of the Czech Civil Code). If any provision of these terms is invalid or ineffective, the other provisions remain unaffected. These terms are valid and effective from 23 October 2026. The operator will send the previous version on request.
